These terms govern your use of PushWard (the "Service"), an APNs gateway for iOS Live Activities. PushWard is the trading name of MAWIK Maciej Kędziora, a sole proprietorship registered in Poland (CEIDG), NIP 8943263728, based in Wrocław, Poland ("we", "us"). PushWard is not sponsored, endorsed, or affiliated with Apple Inc. By using the Service you agree to these terms.
Account & acceptable use
You sign in via Sign in with Apple. You are responsible for all activity under your account, including activity initiated by integration keys you create or share, and for keeping your tokens secure.
You agree not to:
- Send notifications or emails to recipients who have not consented to receive them.
- Send spam, deceptive, harassing, defamatory, infringing, or otherwise unlawful notifications.
- Attempt unauthorised access to other accounts or to the Service infrastructure.
- Reverse-engineer the Service except as permitted by law.
- Overload the Service or circumvent rate limits.
When you use the email channel, you may only send to recipients who have confirmed their address through our double opt-in, you must have a lawful basis to contact them, and you must not use it to impersonate any person or organisation. We send from our own domain on your behalf and may suspend the channel for abuse.
PushWard Team (organizations)
PushWard Team lets a business or other organization run an organization account that sends to its members. It is offered to business customers. By creating an organization or buying a subscription for it, you confirm that you act on behalf of that organization and may accept these terms for it. The rest of these terms apply to organizations as well.
Seats and members
A seat is one member: one person who joins with their own Apple ID. A subscription has at least 3 seats, and the organization can have as many members as it has paid seats. Each paid seat also gives that member the PushWard Plan for as long as they hold the seat. The organization's sending is pooled across its seats; current limits are listed in the docs.
Free trial
Your first organization starts with a free 14-day trial (one per person), with up to 5 members. No payment details are needed and nothing is charged. The trial does not include the PushWard Plan for members. If no subscription is bought by the end of the trial, the organization becomes read-only, its API keys are refused, and 30 days later the organization and its data are deleted.
Paddle, billing and renewal
For PushWard Team, our order process is conducted by our online reseller Paddle.com.
Paddle.com is the Merchant of Record for all PushWard Team orders: Paddle sells the
subscription to you, takes the payment, issues the invoice, handles VAT and sales tax,
and handles customer service for payments and refunds. Paddle's Buyer Terms apply to the purchase. Subscriptions are bought and managed in the web console at console.pushward.app; nothing is sold in the iOS app.
Subscriptions are billed in advance, yearly or monthly, and renew automatically for the same period until canceled. Adding or removing seats is prorated for the rest of the current period. We may change prices: a new price takes effect at the first renewal at least 30 days after we tell the organization's billing contact, so you can cancel first. Refunds follow our Refund Policy.
Failed payments and suspension
If a renewal payment fails, Paddle retries it for a period and the organization keeps working in the meantime. If the payment still does not go through, the subscription ends and the organization is suspended as described below. We may also suspend an organization that breaks these terms.
Cancellation and deletion
You can cancel at any time in the console. The subscription stays active until the end of the period already paid for and then ends. When a subscription ends, by cancellation or failed payment, the organization becomes read-only: its API keys are refused and its members lose the PushWard Plan that came with their seat. 60 days after that, the organization and its data are deleted, unless a new subscription is bought before then. Owners can also delete the organization in the console at any time, which removes its data at once.
Members and their consent
The organization's owners are responsible for how the organization uses PushWard: for having a lawful basis to send to its members, for inviting only people who agreed to receive its notifications and Live Activities, and for removing people who should no longer receive them. Before joining, each member is shown what the organization can see about their devices and what it can send to them. Members accept these terms for their own account and can leave an organization at any time. Contact [email protected] for a data processing agreement.
No warranty and liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. Push delivery depends on Apple's APNs and device settings; we do not guarantee delivery, ordering, or latency. We provide no SLA unless agreed in writing. Do not rely on PushWard for life-safety, medical, or emergency use cases.
Except as set out for PushWard Team in the next sentence, our total aggregate liability shall not exceed USD 50. For a PushWard Team subscription, it shall not exceed the greater of USD 50 and the fees the organization paid for PushWard Team in the 12 months before the event giving rise to the claim. Everything else, including a PushWard Plan that comes with a Team seat, falls under the USD 50 cap. To the maximum extent permitted by law, we are not liable for delivery failures, data loss, or indirect, incidental, special, or consequential damages. Nothing in these terms excludes liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, fraud, or mandatory consumer-protection rights in the EU/EEA or UK).
Termination
You may delete your account at any time through the iOS app, which permanently removes all your data. Organizations are deleted as described in the PushWard Team section. We may suspend or terminate accounts that violate these terms.
Governing law
These terms are governed by the laws of Poland, with exclusive jurisdiction in the courts of Poland. EU/EEA consumers retain any mandatory protections of their country of residence.
